@TechTangents @thomasfuchs What I am confused about is why fair use has been expanded to encompass wholesale piracy - does copyright law allow someone to abuse fair use to "transform" the original work into a virtual facsimile?
It seems to me that somehow, the theory of the case is that if I can copy a sentence, it is fair use, so I can copy a paragraph, and a chapter, and then a book.
Humans can't do that, but LLMs can.
Is there some nuance we are missing or is this a new legal theory?
@yoasif @TechTangents It's all based on Article 10 of the Berne convention, which is very terse and and doesn't go into detail what "fair practice" means; however from context it's clear that they didn't mean large-scale copying or paraphrasing.
I'm not saying I would support it, but a legal way out of this could be compulsory licensing with proper licensing fees to authors (Anthropic lawsuit may be a precursor to this?).

see this is why djb's whole thing where he whines about encryption steps that depend upon secret information seem so dangerous to me. not only does all of that require the same memory range with the key information to be reused across multiple security contexts in the first place but if you make encryption depend upon something that does not "leak" the key data, then you're reducing the information the key is allowed to transfer to the encryption process
and like any encryption process obviously depends upon the message itself, which is also secret data??? obviously??? and i know there are stream ciphers djb makes which ostensibly depend upon the message itself. but the only go......LEFT TO RIGHT!!!! i.e. THE SAME PROBLEM WITH EVERY PARSER EVER!!!!
