Unfortunately, due to a conflict in the court's schedule, the judge has delayed the #Vizio trial and it will not be starting on Monday. It's disappointing news, but hopefully it will be scheduled soon! We'll keep you all posted as we get more information.

Breaking news: the tentative ruling for today's #Vizio hearing just came out in favor of SFC's summary adjudication motion! This isn't a final ruling, but indicates how the judge is leaning in advance of the hearing. The hearing will begin at 10am pacific and will likely begin with other cases scheduled to be heard today.

Such motions are difficult to win, so this is amazing.

#SFC lawyers argue correctly that the Judge got it right in the tentative ruling: the contract we accepted when we exercised the new offer when #Vizio updated their offer during the case.
#Vizio's lawyer dubiously claims that because we said the offer was invalid when the case *started* means we can never test the offer for source later when they fixed it during the case.
Effectively, Vizio is effectively saying if you're in a #GPL lawsuit, you lose your right to even ask for source at all!!!

… is b/c most don't know #LinuxFoundation has (for 10 yrs) slowly become less of a #FOSS org. LF has developed multiple proprietary platforms (e.g., https://sfconservancy.org/blog/2019/mar/13/lf-community-bridge/ ). Mike Dolan of LF is a friendly witness for #Vizio — a known #GPL violator (See https://sfc.ngo/vizio — we expect to release Dolan's transcript soon).
