The filing hit many of the same notes as a similar motion filed last month by fmr FBI dir #JamesComey, who is charged w/ lying to Congress & has asked the judge overseeing his case to dismiss it.
Both Comey’s indictment & the one against #LetitiaJames were secured by the same prosecutor— #LindseyHalligan, Eastern District of Virginia interim #USattorney whom #Trump installed in the post after her predecessor, Erik Siebert, refused to move forward with the cases, citing a lack of evidence.
In a court filing Friday, #LetitiaJames’ attorneys maintained that the mortgage fraud case she’s facing in Virginia is nothing more than an effort at retaliation for the staggering civil #fraud judgment she won against #Trump & his real estate organization last year.
“Since his second inauguration, the President & his handpicked Department of Justice officials exhausted every avenue to secure the payback the President demanded,” defense attorneys Abbe Lowell & Andrew Bosse wrote. “The charges against AG James constitute unconstitutional vindictive & selective prosecution.”

Other career prosecutors in the office had also reached that conclusion, some of whom have since been fired. #Comey & James are both also pursuing motions seeking the dismissal of their cases on grounds that #LindseyHalligan’s appointment was #illegal. A judge has scheduled a hearing next week to weigh arguments on that front.
