The filing hit many of the same notes as a similar motion filed last month by fmr FBI dir #JamesComey, who is charged w/ lying to Congress & has asked the judge overseeing his case to dismiss it.
Both Comey’s indictment & the one against #LetitiaJames were secured by the same prosecutor— #LindseyHalligan, Eastern District of Virginia interim #USattorney whom #Trump installed in the post after her predecessor, Erik Siebert, refused to move forward with the cases, citing a lack of evidence.
Other career prosecutors in the office had also reached that conclusion, some of whom have since been fired. #Comey & James are both also pursuing motions seeking the dismissal of their cases on grounds that #LindseyHalligan’s appointment was #illegal. A judge has scheduled a hearing next week to weigh arguments on that front.
