Mass. Governor Proposes Eliminating Statute of Limitations for Rape When DNA Evidence Exists
---

A WBUR-ProPublica investigation found that no DNA match, testimony or even confession could allow a rape to be prosecuted after the state’s 15-year deadline. The governor aims to “help survivors who have had to wait far too long for justice.”

@ProPublica I think a good case can be made for extending the statute of limitations another ten or fifteen years, but not eliminating them for this type of evidence for this crime.

@ProPublica While I agree the statute needs to at least be longer than 15 years, ideally none, the focus on DNA just makes me think of all the death row inmates in the States who were placed there and later exonerated because of evidence that was discovered or not considered at the time. Ideally, the statute would be stricken without the need for DNA evidence. Plenty of crimes can and do get investigated without it.

inb4 someone tries to twist that last sentence into a presumption I'm not also aware of the pitiful report and even more pitiful conviction rate for rapists. That's something which we not only should pursue a fix for, but would probably be more effective than removing the statute of limitations. It's just not the topic at hand in this specific thread.

@ProPublica how about just getting rid of it altogether? I live in NC where there is no statute of limitation on any felony. You shouldn't be able to get away with a serious crime simply because of the passage of time.

@ProPublica Absolutely. Victims have to live with the trauma for life. The perpetrator shouldn't have a timed get out of jail free card.
