Judge Boasberg still fighting for rule of law. Kristi Noem submitted an unhelpful declaration re her basis for disobeying court order to reverse a flight removing people the US. Noem said she made the decision to ignore the court on the basis of legal advice. Now Boasberg has ordered former DoJ atty Erez Reuveni and current Dep Asst Att Gen Drew Ensign to appear in court. The Trump-Bondi DOJ wanted Boasberg to decide whether to refer Noem or anybody else for criminal contempt prosecution on the basis of her barest of bare bones declaration. Had Boasberg referred anybody for prosecution on the basis of Noem’s declaration, higher courts would have thrown out referral for lack of evidence. 4/
Of course, regardless of how much evidence Boasberg gathers, the Roberts Court will, given the opportunity, put the kibosh on any prosecution or judgment of criminal contempt. But - and here’s where Boasberg’s acumen comes in - one way or another Reuveni’s testimony is going to be part of the judicial record, and hence the historical one. 5/
U.S. Federal District Court judges like Boasberg know that they are hamstrung by the Roberts Court, so they are conducting proceedings and writing opinions for posterity. This is brave, hard work. If/when a reconstruction of U.S. constitutional democracy is attempted having contemporaneous judicial records of how it was destroyed will be exceedingly useful. 6/6
@heidilifeldman After we live through the destruction of the USA why would we ever choose to bring it back??? If I were in one of the Blue states and post-USA they decided to re-unite with Texas or Arkansas I'd personally start a third civil war.
Depending on the results the United States may not keep accurate records of their fascist decline, but the rest of the world will.
i'd say the entire DOJ and WH have complete contempt for court, rule of law, and the judicial branch.
