The Trump regime has appealed the TRO issued by Judge McConnell to the First Circuit. The regime asked the First Circuit to administratively stay the TRO while the the First Circuit deliberated a substantive stay. The First Circuit denied the motion for the administrative stay and said it would decide the substantive stay issue as “quickly as possible.” 2/
Ignoring the First Circuit’s decision to allow the TRO to stand while the Circuit Court decides about a more permanent stay, tonight the Supreme Court accepted a request from the Trump regime to administratively stay the TRO on the ground that “an administrative stay is required to facilitate the First Circuit’s expeditious resolution of the pending stay motion.” 3/
Saying that an administrative stay is necessary for the First Circuit to expeditiously decide the merits of the stay question mere hours after the First Circuit itself said there is no connection between administrative stay and its own quick deliberations is just weird. 4/
The Supreme Court’s administrative stay ends 48 hours after the First Circuit decides the substantive issue of whether to stay Judge McConnell’s TRO while the trial proceeds on whether the Trump regime must fully fund SNAP food benefits. Meanwhile, the Trump has also informed the Supreme Court if the 1st Cir affirms the TRO, it will file a petition for certiorari, asking the Supreme Court to reverse any such decision. 5/
With this administrative stay, the only thing the Supreme Court has guaranteed is that the bulk of billions of dollars in November food benefits will not flow over the weekend and through Monday or Tuesday. Furthermore, if the Supreme Court is asked to respond to the 1st Circuit’s decision on substantive stay, the Supreme Court will certainly grant another administrative one. 6/
Even if the Supreme Court ultimately affirms Judge McConnell’s order requiring full funding of November SNAP benefits - and I’m not at all confident they will - hungry people are probably not getting this month’s SNAP benefits before mid-November. This makes no sense, not as a matter of law nor justice nor morality. 7/

@heidilifeldman@mastodon.social As best I read it, the "strange reason" is to "allow more time to rule on it" to the appeals court that already ruled on it and told Trump to go pound sand.
If I'm missing something that makes this actually make some kind of sane sense, somebody please point it out to me.
