Why is this acceptable? You need to be able to press charges against OpenAI or any AI company that is running a "rogue" agent for hacking or similar malicious attacks. If a normal human does this, they are held responsible. So, the same responsibility should apply here and charges should be pressed against the CTO/CEO/CSO.

Absolutely. Saw elsewhere a recommendation to push back against the term 'rogue agent' as it anthropomorphizes and confers agency. Much better to call it what it is 'malware'.
