As with pretty much all data protection stuff, it will be case / context specific. But what someone does, for the own personal / domestic purposes, will be different, legally, to what someone does outside that (e.g. in the course of a business).

@neil Now imagining a nice little sign on the door saying "by stealing from this establishment, you are consenting to us using CCTV images of you however we feel like - if you object to this use of your personal data, you may do so by sending us your name, address and proof of ID along with the time and date you stole goods from this shop..."
