Remember Kilmar Abrego Garcia? Today, federal Judge Paula Xinis has granted his habeas corpus petition, ordering him released from ICE custody. https://storage.courtlistener.com/recap/gov.uscourts.mdd.589189/gov.uscourts.mdd.589189.111.0_2.pdf 1/ #LawFedi

@heidilifeldman

Thank you for the work you do. The entire thread is so enraging. The Trump Adm just keeps punching down. How are they to be stopped? Private persons do not have the resources to defend against this.

@heidilifeldman ok, but did they actually DO it? Doesn't count until he's sitting on his couch in Maryland with ABC7 shoving a camera in his face.

In the earliest days of the Trump regime's lawless assault on immigrants, especially their due process rights, Abrego Garcia was among the people deported by ICE to CECOT, the torture camp in El Salvador. All sent there were sent without due process. The Trump regime also admitted that Abrego Garcia's deportation was an "administrative" mistake. https://apnews.com/article/el-salvador-deportation-maryland-man-trump-error-818a0fa1218de714448edcb5be1f7347 2/

Rather than act on its own admission of error, the Trump regime started by insisting they didn't have the authority to have him returned from El Salvador. After months, the regime did have him returned -- but only to stand trial on criminal charges in Tennessee. https://www.npr.org/2025/06/06/nx-s1-5425509/kilmar-abrego-garcia-el-salvador-deport-cecot-maryland-ice 3/

Abrego Garcia was released from federal criminal custody on bail, https://www.tennessean.com/story/news/crime/2025/08/22/kilmar-abrego-garcia-free-released-from-custody-el-salvador-immigrant/85781017007/, but after reporting for a mandatory check-in with ICE, he was again put into immigration custody. https://www.npr.org/2025/08/25/nx-s1-5515422/kilmar-abrego-garcia-detained-ice 4/

Starting in August 2025, Abrego Garcia was held in immigration detention. His habeas petition proceedings continued before Judge Xinis. Between August and today, the Trump regime kept notifying Abrego Garcia and Judge Xinis that they were working to remove him to a third-party country (not El Salvador, because long ago an Immigration Court judge had granted him relief from removal there, due to his credible fear of being killed or tortured there). 5/

As Judge Xinis explains in her opinion today, https://storage.courtlistener.com/recap/gov.uscourts.mdd.589189/gov.uscourts.mdd.589189.110.0_4.pdf, the Trump regime created an absurd circus around its renewed, supposed efforts to deport Abrego Garcia. Despite a public offer by Costa Rica to accept Abrego Garcia, and Abrego Garcia's stated willingness to go there, the Trump regime kept claiming it was deporting him to various African countries allegedly amenable to accepting him. I'm sharing the details because they drive home the utter mendacity of the Trump regime. 6/

Trump regime told Abrego Garcia they were removing him to Uganda. Abrego Garcia filed his habeas petition with Judge Xinis's court. To ICE, he expressed a fear of persecution and torture were he to be sent to Uganda. ICE responded by informing Abrego Garcia they were going to remove him to Eswatini. He asserted fear of persecution and torture were he sent there. For its part, Eswatini publicly announced it had not received any communication about Abrego Garcia and wouldn't receive him. 7/
