The agreements with Columbia and Brown include substantive provisions identical to the content of the guidance. For example: "Importance of Sex-separated Intimate Spaces and Athletic Competitions: Compelling employees to share intimate spaces with the opposite sex or allowing men to compete in women's athletic competitions would typically be unlawful." 3/

Throughout the guidance, language that is facially neutral is obviously aimed at protecting white men. Even more clear is the specific, virulent hostility to trans people. For example.... 4/

Provision after provision dismantles any program that ever uses race or gender in any way when allocating resources -- except of course when it comes to "sex separation." 7/
