The 2-page indictment of #JamesComey, the fmr #FBI director, contains so little detail that #legal experts said it was hard to assess its merits.
…The brief indictment was signed by Lindsey Halligan, a[nother] fmr defense lawyer for #Trump whom he had appointed just days earlier as the US attorney for the Eastern District of Virginia—& whose first courtroom experience [ever] came when she presented the case, alone, on Thursday.

The indictment provided no details about evidence that prosecutors would use in a trial, & came even though career prosecutors in the Eastern District of Virginia had found insufficient evidence to support charges.

The indictment asserts that #Comey lied when he testified to senators in 2020 that he had not authorized anyone in the FBI to leak info to the news media about a bureau investigation into an unnamed person. But it was not even clear what episode the indictment refers to.

The #DOJ would have to prove beyond a reasonable doubt that #Comey intentionally lied to the #Senate cmte, “not just that he got something wrong,” Robert Kelner, a lawyer at the firm Covington & Burling, who has represented the #Republican National Cmte & other Republican organizations, posted.

“What evidence do they have for that?” Kelner said, adding, “This isn’t a serious case.”

“This is what prosecutors do in #dictatorships,” Richard W. Painter, a #law professor at the University of MN who served as the chief #ethics lawyer for President George W. Bush, posted.

…#Comey appeared to take the news of the indictment calmly, responding in a video posted on social media. “We will not live on our knees, & you shouldn’t either…I have great confidence in the federal justice system & I’m innocent, so let’s have a trial.”
