From the U.S. 5th Circuit, in a case denying use of public grounds after sunset for free expression activities:
‘The County responds that the curfew provision is narrowly tailored because it is “tied to the time of day when darkness occurs.” Red Br. at 48. But the question is not whether the curfew provision is reasonably related to the earth’s rotation on its axis. The question is whether the provision is narrowly tailored to the County’s public safety concerns.’
