I firmly disagree. The onus is on you (now that I've explained my position against that proposition) to prove me wrong.

That's not really how it works. I haven't seen anything explaining a position, just some conclusory statements and snark. No one anywhere is obligated to respond to such.
There is a solid argument that if the kids downloading metallica on napster weren't copyright infringers then neither are the techlords with AI. That's a fair and plausible argument. That is /not/ the same as saying "AI good."
If you cannot see the distinction, well, honestly, that's your myopia, and not anyone else's problem to fix.

EFF didn’t say that techbros shoving AI up our rectums with the attendant data center fossil fuel water pollution climate change is fine. They just said that it isn’t solved by copyright.
