@davidgerard Small corrections:

It is not true anymore that videos are blocked on YouTube due to GEMA. You could argue that this was more of a YouTube bullying campaign anyway and that GEMA had every right to stand their ground for adequate remuneration, something that large parts of the music world still think is not being offered by YouTube*.

Also Open AI installed guardrails re reproducing lyrics faithfully after 4o afaik.

Edit: GEMA and YT settled in 2016, actually.

@davidgerard *Hilariously, Iving Azoff recently called out YouTube for terrible royalty payments and using its monopoly to do so. Pretty funny coming from ... oh yeah, the former CEO of ticketmaster and chairman of Live Nation. The music world is a fun place. https://www.thewrap.com/irving-azoff-slams-youtube-the-grill-2025/

@davidgerard Re the case, I think Open AI is in a catch-22 here because the judge was very clearly following GEMA's arguments and it is unlikely that other judges higher up the ladder will see it any differently. Bringing this, ultimately, before the European CoJ would be incredibly risky considering we have the AI Act. But if they don't appeal, they will be fucked in the 4th biggest music market in the world, and since this is about lyrics, this would be a feast for the publishing industry.
