@cyberleagle @ApAlun @neil @derickr @JamesBaker this (the snippet you posted) clearly places the burden on the platform provider, not the community manager. Run a group on Reddit or Facebook, they are responsible. Run it yourself, you are responsible..

@jaz @ApAlun @neil @derickr @JamesBaker@social.openrightsgroup. I’m not sure how many would agree that it’s clear. If Ofcom thought so, you would think they would have answered the question instead of just reciting the wording of the Act.

@cyberleagle @jaz @neil @derickr What I see is a general reluctance of regulators to say what is or is not the law for fear of clashing with how the courts interpret the law - you see this a lot with the Health and Safety Executive. I vaguely remember a case where a regulator took some stick for this. It just means that none of really know what the law is until some case law has developed - and then you end up with a complete mess like planning law.

@cyberleagle @ApAlun @neil @derickr regulators are never clear. This is normal. Only Internet folks have trouble with this. Everyone else understands how this works. Architectural. Healthcare. Pharma. Communications. Tarmac. Vague vague vague.

Internet is so unused to regulatory pressure it's bizarrely miscomprehended.

Regulators gonna regulate.

Time has come. Unregulated Internet is done. Goose is cooked. Welcome to everyone else's world. Regs suck. Comply with regs.

@jaz @ApAlun @neil @derickr Believe me, I have enormous sympathy with Ofcom in having to field the hospital pass that they have been given in trying to make sense of this legislation. Nevertheless, when it comes to fundamental, binary questions of scope and compliance responsibility, for which Ofcom have to interpret the Act and have no discretion to exempt anyone from scope or responsibility, I think we really do have to grasp the nettle of what the Act actually says.

@jaz @ApAlun @neil @derickr After all, from the perspective of Ofcom’s own work planning they surely have decide whether they can ignore category ABC because they are out of scope, or whether ABC are in scope and so have to comply, but Ofcom will not prioritise enforcement. The one thing they cannot do is treat services that they decide are in scope as if they were exempt.

@jaz @neil @cyberleagle @ApAlun @derickr speaking as a a non-techy non-legal person who helps run 18+ communities, the new legislation is very scary and makes me angry.
I totally support protecting kids, what I don't like is adults losing their privacy and the march towards the removal of Queerness from places where kids exist because Queer is inherently sexual (just ask YouTube).

I don't have solutions & I know it's complicated, but I'm pretty sure the UK's solution is not it.

@neil @cyberleagle @ApAlun @derickr to put this another way, what can we do to reduce the alarm some ESPs are feeling and get them comfortable continuing operations? That's my goal, keep doing what you're doing, if that needs a risk assessment go do that. If that needs a few rule changes, go do that.

Also, any insight from sitting with, talking to describing issues with, and generally getting in the face of the numerous Ofcom staff who spent the week at #TrustCon.

Both are good inputs. Don't ignore the regs. Don't have a heart attack about the regs. Somewhere is the middle ground that demonstrates good faith and meaningfully advances a safer Internet.
