The social media trial underway in LA is only one of the major challenges to Section 230 that has recently gained traction. It really feels like a dam is about to break https://www.platformer.news/the-infinite-scroll-goes-on-trial/

And now several different legal and regulatory paths are converging on the same target. California's social media addiction act seeks to limit recommendation algorithms from the legislative side. The 41-state AG lawsuit attacks them through consumer protection and privacy law. The jury trial that Zuckerberg testified at this week challenges them as defective products from the liability side.

Even Meta's scam advertising problem has prompted judges to question whether platforms' own terms of service create enforceable duties that Section 230 can't shield them from.

The infinite scroll goes on trial

Testifying before a jury in LA, Mark Zuckerberg makes the case that platform design is about free expression. But the walls are closing in on Section 230

@Casey I sure hope so but we’re dealing with externally slippery individuals so I’m not holding my breathe

@Casey Brian Reed @ Question Everything has an excellent series of reporting on this topic. Like everything, repealing sec. 230 has many upsides but it will affect aspects of the internet you find helpful as well. It’s complicated but we can find a solution, if we want to. Thanks for bringing attention to this

@sololikehan love Brian but worry he's not considering the downsides enough! I'm in favor for limited liability for 'defective product'-style complaints, but want to maintain strong protections for liability from speech-related harms. It's a tough needle to thread but feels really high stakes to me!
