@cbcnews @canada-cbcnews the notwithstanding clause makes the wrong balance between democratically elected government and individual and collective human rights. It was designed as an emergency measure, and now it's become boilerplate. It's been abused.

@cbcnews @canada-cbcnews sorry, but the notwithstanding clause is dangerous garbage, and in an era of rising authoritarianism, we need to remove the tools of governments to override our human rights, even temporarily.

@evan The #NotwithstandingClause should be only a break-glass sort of measure, yes. But it's being used more frequently these days because courts are striking down laws on less plausible interpretations of the Charter. There are even recent cases in which the Supreme Court has reversed itself on what the correct interpretation of the Charter should be: https://www.readtheline.ca/p/brian-dijkema-i-defended-the-courts

I can see the concern about a wayward SCC but I'm not sure how people being upset with, for example, Danielle Smith's use of the clause, are supposed to feel relieved about its existence.
