Lawsuits like this one are not something to celebrate just because you hate Fox News.

I'm not normally one to agree with Fox, but they're right in their statement that suits like this are "designed to chill free speech critical of [Newsom]."

@molly0xfff nope. #FoxNews slanders people with les every day. Slander with intent and malice, which Fox does relentlessly is a crime and not protected by the first Amendment. It will not "chill" their free speech. It will get them to at long last obey tge laws which govern their use of public communications infrastructure. #FoxLiesDemocracyDies

@molly0xfff I disagree. If a so called news organization gets a story factually wrong, then at the very least, they must issue a correction to that story. Now one could argue that it’s a “Newsome said, Trump said” situation, but who do you think is the more likely liar? For me, if Trump says the sky is blue, I’m going to step out side and check.

@billclawson I don't think "media outlets should issue corrections/retractions if they err in their reporting" and "politicians shouldn't file $700M+ defamation suits against media organizations over erroneous statements (or, quite reasonably, expressions of opinion by their talking heads)" are incompatible beliefs

@molly0xfff I disagree. Fox is not "news" it is propaganda and therefore not covered under the first amendment.

@molly0xfff the only part of it that doesn’t look good to me is the amount; Fox spent years lying about Dominion, if the amount of money is supposed to reflect the amount of harm, Newsom should should be seeking a much smaller amount

Like, he's spending a lot of money on a stunt that will only impress "The West Wing was my Star Trek" kind of voters.

@molly0xfff The last decade has shown us that "what if they start using the same tactics?" has been an utterly impotent concern. Precedent and norms will not and have not been a factor for fascists in the slightest.

Winning against nazis isn't the most important thing. It's the only thing.

@molly0xfff I don't disagree that this is “bad" lawsuit. But I feel like the actual intention is to call attention to Trump's constant suing people like this. Maybe I'm giving Newsom too much credit.

@molly0xfff That's a tough one. I don't think that suit is going to do Newsom any favors politically, win or lose. On the other hand truth rarely seems to be considered when it comes to Fox News reporting. Especially in the Trump era. The goal is spread the lie faster than the people telling the truth.

@molly0xfff the concern here is establishing precedent, isn’t it? But in the environment established by the Roberts court, stare decisis doesn’t exist any more and the courts are just a raw exercise of power, red in tooth and claw. I am no Newsom fan, he should apologize and resign for other reasons, but depriving Fox News of resources is something to celebrate particularly if any precedents it establishes either way will be ignored by partisans in the future

@molly0xfff people way too often forget that lawsuits don't exist in a vacuum and the legal precedent they leave behind can be weaponized by anyone, including the completely opposite party. I'm always worried every time a defamation suit like this is filed because, sure, Newsom is 100% the kinda snake that would abuse it to eliminate criticism, but so would half the Democrats and then there is the entire Republican Party, which made it their personal passion hobby of choice to slander, abuse, attack and brutalize people who aren't even that critical at all.

@molly0xfff hard disagree. But I don’t think free speech should protect lies. So like he said: If they lied to the American people they deserve to pay the price. And if they didn’t a judge will find them not liable for what they said.

Any democracy should protect but journalism has an obligation to protect the truth. Fox News does not do that. Are they the only ones guilty of that? No. Are they guilty of what Newsom accuses them of? That’s for a court to decide.
