One major issue hanging over oral arguments is the extent to which the #Trump admin must refund tariff revenue in the event that the justices find its policies to be illegal.

Speaking on behalf of the challengers, #Katyal acknowledged it is a “difficult” question. But he generally seemed to suggest the court had many options at its disposal & could reconcile that later—including, for example, by limiting its decision “to prospective relief.”

Benjamin Gutman, Oregon’s solicitor general, is making his first oral argument appearance before the justices on behalf of a group of #states that challenged the #tariffs.
#Kavanaugh asked, why would #Congress give the president the power to shut down #trade but not to take a less severe step, like impose a 1% tariff. That, he said, appeared to underscore the govt’s claim, creating an “odd donut hole in the statute.”
“It’s not a donut hole,” responded Gutman. “It’s a different kind of pastry.”

Justice #Kavanaugh points to FEA v. #Algonquin, a 1976 tariff that was upheld by #SCOTUS.

The court unanimously ruled for President Gerald Ford in a case about the imposition of #tariffs on oil imports, based on a different statute that also doesn’t mention the word tariffs.

“The court 9-0 rejected the argument” that the absence of the word tariff doomed Ford’s action, Kavanaugh said.

#Katyal responded to #Kavanaugh that #Algonquin was one import. Not #tariffs broadly applied to numerous countries across the board.

“Algonquin was expressly a trade statute,” Katyal said. “It’s everything this case isn’t.”
He said the Algonquin decision had a reference to #duties in a specific provision & an extended, clear legislative history describing the powers given to a president.

#Katyal argued that the president has other authority to impose #tariffs, without relying on a national emergency.

For example, he cited Section 122 of the Trade Act of 1974, which allows the president to combat trade deficits by imposing tariffs of up to 15% for up to 150 days without congressional approval.

Earlier, Justice #Kavanaugh gave #Louisiana’s lawyer an opportunity to push back on the #NAACP lawyer’s warning of “catastrophic” implications if the court strikes down §2 & the possibility that none of Louisiana’s 6 congressional districts would be majority-minority.

The state’s lawyer says, “I don’t know what our legislature would do,” but adds, “I don’t think the sky is going to fall.”

#Kavanaugh *again* comes back to the question of whether the country might come to a point where it no longer needs to take #race into account when drawing voting districts.

Aguiñaga, the Louisiana solicitor general, essentially argues that we’re there already [oh really?]:

“I think the warning bells have been sounding for decades, & I think that’s a long enough notice for anybody involved.”

“The issue, as you know, is that this court’s cases, in a variety of contexts, has said that race-based remedies are permissible for a period of time … but that they should not be indefinite & should have an end point,” he said.

#SCOTUS is hearing arguments Wednesday over a core provision of the #VotingRightsAct that is designed to protect racial minorities.

Lawyers for #Louisiana & the #Trump admin [the first admin ever to challenge the law] will try to persuade the justices to wipe away the state’s 2nd majority Black congressional district & make it much harder, if not impossible, to take account of #race in #redistricting.

Roberts & #Kavanaugh are the ones to watch

Along with the three liberal justices, #JohnRoberts & Brett Kavanaugh were part of a surprising decision two years ago that required #Alabama to redraw its congressional districts to benefit Black voters and led to the new map in #Louisiana as well.

The outcome likely will be different if either justice votes differently this time around.

…In overturning the lower court’s decision, 5 of #SCOTUS’ 6 #RightWing justices…took advantage of their right to remain silent, but Justice Kavanaugh gamely tried to speak up in a concurrence. If his goal was to be reassuring, he did not help matters: Such stops are usually “brief,” he explained. I am not a scholar of the #Constitution, but I had no idea that I could be deprived of my rights under the #4thAmendment …as long as my getting roughed up takes only a few moments….

A California district-court judge had earlier enjoined ICE from making such stops, perhaps appalled by this example:  Plaintiff Jason Brian Gavidia is a U.S. citizen who was born and raised in East Los Angeles and identifies as Latino. On the afternoon of June 12, he stepped onto the sidewalk outside of a tow yard in Montebello, California, where he saw agents carrying handguns and military-style rifles. One agent ordered him to “Stop right there” while another “ran towards [him].” The agents repeatedly asked Gavidia whether he is American—and they repeatedly ignored his answer: “I am an American.” The agents asked Gavidia what hospital he was born in—and he explained that he did not know which hospital. “The agents forcefully pushed [Gavidia] up against the metal gated fence, put [his] hands behind [his] back, and twisted [his] arm.” An agent asked again, “What hospital were you born in?” Gavidia again explained that he did not know which hospital and said “East L.A.” He then told the agents he could show them his Real ID. The agents took Gavidia’s ID and his phone and kept his phone for 20 minutes. They never returned his ID.

#Kavanaugh also noted in his concurrence that illegal #immigration “is especially pronounced in the Los Angeles area, among other locales in the United States.” Yes, America has an illegal-immigration problem in various “locales,” & therefore … what? #ICE officials can use #race-based criteria in an area with a lot of #Spanish-speaking citizens?
