The case focused on a policy shift…that authorized #DHS to launch quick #deportations, across the country & without court proceedings, of undocumented immigrants who cannot prove they have lived in the country for >2yrs.
Known as expedited removal, such deportations have been carried out for decades, but of people arrested at or near the southern border. The #Trump admin sought to expand the practice nationwide, to hasten the removal of people arrested deep inside the country.

In reaching her decision, Judge Cobb took particular note of the aggressive evolution of the #Trump administration’s #immigration policy in recent months.

She wrote that in a race to meet quotas — as high as 3,000 immigration arrests per day — the administration had resorted to staking out #courthouses, targeting people pursuing #asylum claims & other pathways to remain in the country legally.

Cobb also forcefully rejected the #Trump admin’s argument…that immigrants who crossed the border illegally forfeited certain protections, such as the right to fight their removal in court. She warned the argument was so broad it could easily ensnare US citizens.

“In defending this skimpy process, the government makes a truly startling argument: that those who entered the country illegally are entitled to no process under the #FifthAmendment…,” she wrote.

"In the first half of the year, at least 19 out of 49 dedicated detention facilities exceeded their rated bed capacity and many more holding facilities and local jails exceeded their agreed-upon immigrant detainee capacity.

"'There are so many things we’ve seen before — poor food quality, abuse by guards, not having clean clothes or underwear, not getting hygiene products. But the scale at which it’s happening feels greater, because it’s happening everywhere and people are sleeping on floors.'"

She wrote that the #Trump admin had taken over a process that was once as simple as turning back immigrants w/negligible ties to the US “after a single conversation with an immigration officer” near the southern border, making it a default practice in places as far away as NY.

“When it comes to people living in the interior of the country, prioritizing speed over all else will inevitably lead the government to erroneously remove people via this truncated process,” Cobb wrote.

In a 48-page opinion, Judge Jia M. Cobb of the U.S. District Court for the District of Columbia wrote that the #Trump administration had acted recklessly in a frenzied effort to quickly remove as many people as possible, likely violating #DueProcess rights & risking #WrongfulDetentions.

Judge Jia M. Cobb rejected what she called “a truly startling argument” from the government.

A federal judge on Friday blocked the #Trump admin from carrying out fast-track #deportations of people detained far from the southern border, removing, for now, one of the cornerstones of Trump’s campaign to carry out #MassDeportations.

The Trump administration has expelled more than 8,100 people to places where they do not hold citizenship since January 20. https://theintercept.com/2025/08/25/trump-kilmar-abrego-garcia-deport/

@theintercept If you want a lesson in how to radicalize 8100 people, send them to a country where they have no ties, no source of income, no common language and a growing hatred for the country and the people who sent them there.

People who follow Trump (and some others) think the only groups that become radicals are Muslim. They would be wrong.

Trump isn't ridding the United States of terrorists, he's creating them.

"The Trump administration announced Monday it was processing Kilmar Abrego Garcia for expulsion to Uganda, threatening to banish him to the United States’ growing network of deportee dumping grounds for the second time."

I've long been following Dara Lind's reporting on immigration, at Vox and ProPublica in the past. Here's her excellent recent summary of what's going on DC.

"To understand what’s going on in D.C., it’s important to know that there are two distinct components to the federal takeover.

"One is the deployment of the National Guard – now including six states and counting, in addition to the D.C. guard – that is similar to what we saw in Los Angeles earlier this summer, with National Guard troops being used as a force multiplier to intimidate immigrants and their neighbors and carry out a 'show of force' in areas with high visibility.

"But the second, unique to D.C. and arguably more important, is the Trump administration’s use of the takeover to change rules about how the D.C. police operate."

When the turtle god surfaced with a glowing sword in its beak, would I be ready to take it—to wield my Vietnamese identity like the sword itself and lead my people into a glorious age of prosperity and cultural dominance? There’d be a bánh mì stand on every corner and phở in every pot, and anyone who uttered the words 'Ching chong, ling long' to an Asian person would be swiftly beheaded."
